Title TipsWhat is a Life Estate? A life estate is an estate one or more individuals have in real property during their lifetime and their interest in the real estate terminates upon their death. The owner of a life estate is called a "life tenant". How can a property that is subject to a Life Estate be sold? If the property is sold while the life tenant(s) to the life estate is still living, ALL Parties in title must sign the deed including the life tenant(s). This terminates and conveys any interest they have in the property to the new purchasers. If the property is sold and the party to the life estate is deceased, proof of death should be provided to the title company closing the transaction and the remaining parties in title must sign the deed.
