Time to Check your Lakerights

The Wisconsin Department of Natural Resources ( DNR ) has been working on new shoreline zoning regulations for the past 3 years and will be having public hearings on the proposed new rules starting next month. These changes will be applied to existing homes and property, and include:

  1. Strict limits on the size of homes and the amount of impervious surface areas (structures, driveways, decks, etc.) within 300 feet of the water.
  2. Increased minimum lot size requirements.
  3. New standards for measuring the width of new and existing lots.
  4. Prohibiting all expansion of buildings located within 35 feet of the water.
  5. New restrictions on the removal & trimming of brush & trees between your home and the water.

Wisconsin Struggles for a new Budget

The Governor, Senate and Assembly each have their own thoughts on the next biennium budget for the state. Below is a quick comparison of the Wisconsin state budget by each group, as compared to the current budget.

  1. Governor Doyle - $58 billion proposed budget - 9% increase
  2. Senate - $66 billion proposed budget - 23% increase
  3. Assembly - $56 billion proposed budget - 5% increase

There has been a 4.3% increase in Wisconsinites’ personal income from 2005-2006.

State Transfer Tax Update

The governor and the State Senate have proposed doubling the transfer fee from $3/$1000 of sale price to $6/1000. The State Assembly version proposes reducing the current $3/1000 tax to $1/1000 over a number of years.. At the present a conference committee of 8 state legislators have been assigned the task of coming up with a final recommendation on this issue.

Title Tips

My Title Company says I need to provide a deed and transfer when I sell my home, what does that mean?

To put it simply the Deed will change how title is held for your real property.

In a sale transaction you will be asked to provide a Deed. There are several types of Deeds, but the most common in Wisconsin is the Warranty Deed. An attorney should draft the Deed that will convey the property to the new buyers. For example: John E. Appleseed and Jane B. Appleseed, Husband and Wife conveys and warrants to George Washington and Martha Washington, Husband and Wife, the following described real estate:

The deed will further describe the legal description of the property, dates, signature of Grantors/sellers and must be notarized and recorded. The Deed is recorded at the Register of Deeds at the County in which the property is located and the Transfer Tax (fee paid to the State) is paid at that time.

The Transfer Tax is calculated on the sales price of your home (currently $3.00 per $1000 in Wisconsin). The tax is paid at the same time the Deed is recorded and the property taxes are simultaneously then changed to the new owner. Information is gathered for the Transfer Return at the closing such as, Grantor, Grantee, sales price and type of transfer.
